1. PURPOSE AND SCOPE
These General Terms and Conditions of Sale (hereinafter, the "T&Cs") govern the contractual relationship between Patternland and any natural or legal person (hereinafter, the "Customer") who purchases garments through the system organized by Patternland.
Patternland acts as the organizing entity of a made-to-measure (MTM) and on-demand garment production system, based on a network of independent professionals (designers, pattern makers, and manufacturers).
These T&Cs are binding and integrate with the following policies:
- Measurement and validation policy
- Adjustment and compliance policy
- Production and manufacturing policy
- Dispute and incident resolution policy
- Intellectual property policy
2. BUSINESS MODEL AND DISTRIBUTED PRODUCTION
Patternland is a digital infrastructure that organizes, coordinates, and controls the production of customized garments through a distributed production model.
Garments are not standardized products but individual pieces developed on demand for each Customer.
Patternland:
- Defines technical and quality standards
- Establishes validation protocols
- Coordinates participating professionals
- Supervises the production process
3. NATURE OF THE PRODUCTS
The garments sold are customized products made to order, which implies inherent variations in the process:
- Color differences between screen and actual product
- Variations in drape, texture, and fabric behavior
- Variable elasticity depending on composition
- Non-identical placement of prints or patterns
- Technical tolerances in measurements and manufacturing
- Handcrafted finishing characteristics
The Customer acknowledges that these characteristics do not constitute defects.
4. PURCHASE PROCESS AND MEASUREMENT VALIDATION
The Customer enters their body measurements under their sole responsibility:
- Accuracy of measurements
- Anatomical consistency
- Correct measurement taking
Patternland may:
- Detect anatomical inconsistencies
- Request additional confirmations
- Require new measurements
- Apply technical criteria
- Temporarily suspend the order
- Block the process until validation
Lack of response from the Customer may result in order suspension without compensation.
5. PRODUCTION AND MANUFACTURING
Production is carried out through a network of independent professionals in a distributed system.
- Involvement of different actors
- Internal technical validations
- Dependence on materials
- Technical adjustments during execution
Patternland coordinates the process but is not the direct manufacturer.
6. PRODUCTION AND DELIVERY TIMES
Timeframes are estimates and may vary due to:
- Design complexity
- Material availability
- Production capacity
- Technical or logistical incidents
Delays resulting from these circumstances shall be considered reasonable.
7. SHIPPING AND DELIVERY
Risk is transferred to the Customer upon actual delivery.
Until that moment, Patternland assumes transport unless directly contracted by the Customer.
8. RIGHT OF WITHDRAWAL
This does not apply to customized or made-to-measure (MTM) products.
9. CLAIMS, ADJUSTMENTS, AND DISPUTES
The Customer must:
- Report incidents within the required timeframe
- Provide evidence (photographs, detailed information)
Patternland will evaluate:
- Customer responsibility
- Technical tolerances
- Production incidents
Patternland may:
- Offer adjustments or repairs
- Request additional information
- Reject the claim with justification
Returns are considered only in exceptional cases.
10. LIMITATION OF LIABILITY
Patternland shall not be liable for:
- Errors in Customer measurements
- Anatomical inconsistencies
- Material variations
- Technical tolerances
- Subjective expectations
- Reasonable delays
In no case shall it be liable for:
- Indirect damages
- Loss of profit
- Loss of opportunities
Maximum liability is limited to the amount paid by the Customer.
11. APPLICABLE LAW AND JURISDICTION
These T&Cs are governed by Spanish law.
Disputes shall be subject to the courts of the consumer’s place of residence.
